According to Health care IT News, hospitals that don’t take the right steps to correct a HIPAA violation are subject to large fines. St. Elizabeth’s Medical Center in Brighton, Massachusetts was fined more than $218,000 for not using secure documentation methods to track patient records. The facility had been using an open share, online document sharing platform instead of secured EHR software, which left patient data vulnerable to data hacks and information breaches. The OCR has collected more than $28 million in fines since enforcement began in 2003. Health care IT News reports that the Presbyterian Hospital/Columbia University Medical Center was fined when just one doctor accidentally deactivated a server that allowed records to be accessed publicly online. The Health Insurance Portability and Accountability Act (HIPAA) was established to set national standards to protect individual’s medical records and other personal health information. HIPAA training is mandatory for anyone who comes into contact with protected health information (PHI). Hospitals in Texas are also subject to penalties resulting in noncompliance of Texas Health and Safety rules and regulations. Hospital employees are required to complete Texas H.B. 300 compliance training as well as HIPAA compliance training. It’s vitally important for hospital employees to understand and comply with the HIPAA and Texas H.B. 300 rules in order to avoid potentially costly mistakes. Federal HIPAA fines range from $100 to 1.5 million dollars and Texas H.B. 300 fines range from $5,000 to $250,000.
